Facts

The appellant was arraigned at the High Court of Ogun State, Ilaro Judicial Division on a two count charge of causing death by dangerous driving and dangerous driving.

The appellant was convicted on both counts and sentenced to three (3) years imprisonment with an option of N5, 000 fine.

The appellant’s appeal to the Court of Appeal was dismissed thereby affirming the conviction and sentence of the trial court.

Dissatisfied, the appellant appealed to the Supreme Court.
